More buzz on Syracuse Football's Pinstripe Bowl win over West Virginia

The Syracuse Orange football team are basking in the glory of their second New Era Pinstripe Bowl victory in three seasons,a 38-14 win over West Virginia at a very snowy Yankee Stadium. What makes the title even more sweet for the Orange is the fact that they beat the Mountaineers, their old Big East rivals, for the third straight time.

Prince-Tyson Gulley was the MVP, scoring three touchdowns, while the SU running game was a good as they've been all season long, finishing with a season-high 369 yards.

The New York Times describes Syracuse's win?as "a parting shot" shot to the rivalry. The Mountaineers just completed their first season in the Big 12, while the Orange now head to the Atlantic Coast Conference.

SU Quarterback?Ryan Nassib told Fox Sports?that?Saturday's win?was a first for his football career.? "This is huge because I've never won my final game," said Nassib. "High school, JV, you know, never won it so I was a little nervous coming into this one. This was a great one to take."

Hi. I am looking for tutorials on developing DirectX 11.0 desktop games using the new?DirectX SDK (which is part of the new Windows SDK 8.0).?Most tutorials I found ask about downloading the June 2010 DX SDK.

I have Visual Studio 2012 ultimate installed on Windows 8 Pro.

Part II of this article discussed how individuals historically incorporated their businesses in the hopes of avoiding personal liability, but then often became dissatisfied with the so-called ?double taxation? thereby resulting. This, among other motivations, brought the S-corporation and then, the limited liability company (LLC), into being. As a New York entertainment lawyer practicing in this day and age, I most often see limited liability companies (LLC?s) as opposed to other forms of entities used in film, music, television, publishing, and Internet businesses. However one cannot understand and appreciate the advantages typically provided by the limited liability company (LLC) unless superimposed as bas-relief upon the entity?s historical context ? which gives further meaning to the LLC across all sectors and industries including entertainment and media.

Society clearly benefits from encouraging people to start businesses - and take some commercial risks without an attendant risk of personal ruin. Yet otherwise well-intentioned and well-motivated people were either quitting businesses or exposing themselves to personal liability - in both instances due to their aversion to the so-called ?double layer of taxation? engendered by the C-corp. Additionally, the ?double? taxation of the C-corp was creating a disincentive for new people to go into business - particularly those who were risk-averse. There had to be a better way.

That better way, at the time, was the S-corp, which came into existence a number of years ago principally for the above types of reasons and rationales. It was named after a ?Subchapter-S? in the Internal Revenue Code of the United States, and was regularly recognized by the IRS and state tax authorities alike. One of the familiar tasks for an entertainment lawyer became the act of ensuring that clients timely made their appropriate S-corp elections (see below) with appropriate governmental authorities ? hardly the romantic notion one would have of what it is like to interact with talent and go to celebrity premieres..

Akin to the C-corp in most other respects, the S-corp only mandated a single layer of taxation, as opposed to the C-corp?s double layer of taxation. But there were also a few catches.

One had to make a formal written ?election? (or in some cases, ?elections?) to qualify as an S-corp. If one didn?t do so in time by a strict deadline, one would lose S-corp status and be ?doubly? taxed like a C-corp instead. As most entertainment lawyers can attest, this kind of eventuality could actually snuff out a fledgling entertainment or media start-up business in its first years of existence, already engaging in risky and speculative business activity as is often the case in media and entertainment.

There were other restrictions on S-corps, too, such as a limit on the number of shareholders, a limit on foreign ownership, and a limit on corporate parent-subsidiary ownership. Some of these restrictions have been loosened - and in some cases eliminated - in recent years; so one should not rule out the S-corp without first updating its tax code requirements with one?s lawyer ? entertainment lawyer or otherwise ? as well as one?s tax accountant. The historical restrictions of the S-corp put business owners in a ?Catch-22? situation - they clearly wanted a single layer of taxation, but in the context of an entity that wasn?t so restricted. The newer solution: scrap the idea of a corporation at all, and instead form a limited liability company, or LLC.

The limited liability company (LLC) is akin to the S-corp but without most of the attendant historical restrictions. Yes, there were a certain number of restrictions on the LLC, too, when it first appeared on the scene - most of which were subsequently lifted by either the IRS or state legislatures, or both. Again, S-corp restrictions have also been lifted in recent years, making the S-corp and limited liability company (LLC) look more similar to each other as time goes on.

But even as of this writing, the limited liability company (LLC) is usually considered the most advantageous entity from a tax perspective of all 3 most commonly available forms, for the small business owner to create. As a media and entertainment lawyer, the LLC is the entity which I am most often asked to create. The LLC is also considered the most flexible of all 3 entities. What does ?flexible? mean? Well, it is considered easier to adapt the LLC to later-occurring additional equity-holders in one?s business, for example, which is another familiar task for an entertainment lawyer in the context of artistic co-ventures - and the word ?easier? in this context translates to ?less legal fees?. The LLC is in most cases an entity which is easier to manage and administrate.

There are some disadvantages to the limited liability company (LLC), too. The LLC can take more time to finalize, and in some cases can be more expensive to form and/or file with the government - as compared to an S-corp. Some states historically prohibited 1-person LLC?s. Some states still have an underdeveloped body of judicial case law on the LLC, since the entity is still quite new in many states - so the treatment of the LLC under the law may be less certain than the treatment of a corporation. We in New York have an odd restriction, too, as a result of the powerful newspaper and media lobby galvanized during the legislation?s enactment which as a media and entertainment lawyer I suppose that I should not begrudge. This restriction may be present in another state or two as well in analogous form. The restriction is this: if one elects to form a New York LLC, one must publish its existence in periodicals for a number of weeks, before being accorded the legal privilege of initiating a litigation - as a plaintiff - in the LLC?s name in the New York courts. Publication of an LLC?s naissance in Manhattan is expensive - the publication of a limited liability company in periodicals of the creation of a proposed Manhattan LLC can range between $1,000 and $3,000 (the figures can vary and are smaller in other parts of New York State apart from Manhattan).

Even so, the limited liability company (LLC) is considered the trend-setting entity of those ?in the know?, across the country. As an entertainment lawyer in New York, I have noticed that hipster Californians gravitate to LLC?s just as much as hipster New Yorkers seem to do. And part from hype, assuming that one can afford to form an LLC, and assuming that one can live with whatever restrictions apply to the LLC in one?s jurisdiction, it may in fact be the entity of choice, and an improvement over the older S-corp and C-corp structures.

A limited liability company (LLC), though frequently mistaken for a corporation, is technically not considered a corporation ? rather, it is an unincorporated entity under the tax code, more like a partnership than anything else, but one that (like the S-corp and C-corp), if properly formed and maintained, should provide its members with insulation against personal liability.

If one doesn?t incorporate or form a limited liability company (LLC), the business will likely be what is known as either a sole proprietorship (if a 1-person company), or a general partnership, de facto or otherwise, (if comprised of 2 or more persons). Any entertainment lawyer or other lawyer will opine that this could result in unlimited personal liability for the entity?s owner or owners. Again, that means that an owner?s personal assets can be at risk to satisfy the obligations and debts of the business. Any entertainment lawyer or other lawyer will opine that personal liability is not a risk worth taking. In addition, using a corporate entity or limited liability company (LLC) ? particularly an LLC in this day and age - could add a good deal of ?cachet? or credibility to one?s business endeavors, in the eyes of other persons and companies with whom the business has contact.

Judge approves Toyota's settlement

SAN FRANCISCO --?A U.S. judge granted preliminary approval on Friday to Toyota Motor Corp's $1.1 billion settlement of a class-action lawsuit brought by consumers who lost value on their cars due to sudden, unintended acceleration.

U.S. District Judge James Selna in Santa Ana, Calif., scheduled a hearing in June for final approval of the deal, which was announced this week. It provides $500 million in cash for plaintiffs, plus installation of break override systems and a customer support program valued at about $600 million combined.

"Settlement will likely serve the interests of the class members better than litigation," Selna wrote.

Plaintiff lawyer Steve Berman said he was pleased with the favorable comments in Selna's order. Toyota spokeswoman Julie Hamp said the company was gratified by Selna's approval of the settlement, "which will provide value to our customers and provides an extra measure of confidence in their vehicles."

About 16 million Toyota, Lexus and Scion vehicles sold in the United States spanning the model years 1998 to 2010 are covered by the settlement. Company officials have maintained that the electronic throttle control system was not at fault, instead blaming ill-fitting floor mats and sticky gas pedals.

A study by federal safety officials at the National Highway Traffic Safety Administration and NASA found no link between reports of unintended acceleration and Toyota's electronic throttle control system.

Toyota, the No. 3 automaker in the U.S. market, admitted no fault in proposing the settlement, one of the largest U.S. mass class-action litigations in the automotive sector. One plaintiff's law firm called it the largest settlement in U.S. history involving auto defects.

However, the deal does not cover wrongful death or injury lawsuits, believed to total more than 300 according to a Toyota filing in June.

Toyota's recall of its vehicles between 2009 and 2011 relating to the unintended acceleration issue hurt its reputation for reliability and safety.

But the automaker's sales were up almost 29 percent in 2012 through November, compared with a 14 percent increase in the industry, and Toyota's share of the U.S. market has risen to 14.4 percent from 12.7 percent in 2011.

In his order on Friday, Selna said the settlement is fair, given the risks of further litigation and the complicated legal rulings he has issued throughout the case.

"Some of these rulings have been favorable to plaintiffs, some have been favorable to Toyota," Selna wrote. "Were the parties to proceed to a fully litigated result, virtually any outcome would face the risk of uncertainty upon appellate review of these rulings."

Selna also approved up to $200 million in attorneys' fees, saying the amount falls within 25 percent of the total settlement which is the benchmark established by appellate law.

We?re approaching the end of one year and the beginning of another, when people resolve to quit smoking, swill less booze, gobble less ice cream, jog every day, or every other day, work harder, or less hard, be nicer to kids, spouses, ex-spouses, co-workers, read more books, watch less TV, except Homeland, which is awesome. In other words, it?s a time when people seek to alter their life trajectories by exercising their free will. Some mean-spirited materialists deny that free will exists, and this specious claim?not mere physiological processes in my brain?motivates me to reprint a defense of free will that I wrote for The New York Times 10 years ago:

When I woke this morning, I stared at the ceiling above my bed and wondered: To what extent will my rising really be an exercise of my free will? Let?s say I got up right . . . now. Would my subjective decision be the cause? Or would computations unfolding in a subconscious neural netherworld actually set off the muscular twitches that slide me out of the bed, quietly, so as not to wake my wife (not a morning person), and propel me toward the door?

One of the risks of science journalism is that occasionally you encounter research that threatens something you cherish. Free will is something I cherish. I can live with the idea of science killing off God. But free will? That?s going too far. And yet a couple of books I?ve been reading lately have left me brooding over the possibility that free will is as much a myth as divine justice.

The chief offender is The Illusion of Conscious Will (MIT Press, 2002), by Daniel M. Wegner, a psychologist at Harvard. What makes Wegner?s critique more effective than others I?ve read over the years is that it is less philosophical than empirical, drawing heavily upon recent research in cognitive science and neurology. Wegner also carries out his vivisection of free will with a disturbing cheerfulness, like a neurosurgeon joking as he cuts a patient?s brain.

We think of will as a force, but actually, Wegner says, it is a feeling ? ?merely a feeling,? as he puts it ? of control over our actions. I think, ?I?m going to get up now,? and when I do a moment later, I credit that feeling with having been the instigating cause. But as we all know, correlation does not equal causation.

When neurologists make patients? limbs jerk by electrically zapping certain regions of their brains, the patients often insist they meant to move that arm, and they even invent reasons why. Neurologists call these erroneous, post hoc explanations ?confabulations,? but Wegner prefers the catchier ?intention inventions.? He suggests that whenever we explain our acts as the outcome of our conscious choice, we are engaging in intention invention, because our actions actually stem from countless causes of which we are completely unaware.

He cites experiments by psychologist Benjamin Libet in which subjects pushed a button whenever they chose while noting the time of their decision as displayed on a clock. The subjects took 0.2 seconds on average to push the button after they decided to do so. But an electroencephalograph monitoring their brain waves revealed that the subjects? brains generated a spike of brain activity 0.3 seconds before they decided to push the button. The meaning of these widely debated findings, Wegner says, is that our conscious willing is an afterthought, which ?kicks in at some point after the brain has already started preparing for the action.?

Other research has indicated that the neural circuits underlying our conscious sensations of intention are distinct from the circuits that actually make our muscles move. This disconnect may explain why we so often fail to carry out our most adamant decisions. This morning, I may resolve to drink only one cup of coffee instead of two, or to take a long run through the woods. But I may do neither of these things (and chances are I won?t).

Sometimes our intentions seem to be self-thwarting. The more I tell myself to go back to sleep instead of obsessing over free will, the wider awake I feel. Wegner attributes these situations to ?ironic processes of mental control.? They may end up, Wegner says, like Dr. Strangelove, whose left hand frantically tried to keep his right from jutting out in Nazi salutes.

Perfectly healthy people may lose their sense of control over actions their brains have clearly initiated. When we are hypnotized, playing with Ouija boards, or speaking in tongues, we may feel as though someone or something else is acting through us, whether a muse, ghost, devil, or deity. What all these examples imply is that the concept of a unified self, which is a necessary precondition for free will, may be an illusion.

Wegner quotes Arthur C. Clarke?s remark that ?any sufficiently advanced technology is indistinguishable from magic.? Because we cannot possibly understand how the fantastically complex machines in our skulls really work, Wegner says, we explain our behavior in terms of such silly, occult concepts as ?the self? and ?free will.? Our belief in our personal identity and self-control does have its uses, Wegner grants; without it, ?we might soon be wearing each other?s underclothing.?

Maybe I should lighten up and embrace my lack of free will and a self. That?s what Susan Blackmore, a British psychologist and a practitioner of Zen, advises. In her book The Meme Machine (Oxford University Press, 1999), she contends that our minds are really just bundles of memes, the beliefs and habits and predilections that we catch from one another like viruses. Take all of the memes out of a mind, and there is no self left to be free.

Once you realize you have no control over your destiny, says Blackmore, you will expend less energy regretting past decisions and fretting over future ones, and you will be more appreciative of the vital present. Be here now, and so on. In other words, true freedom comes from accepting there is no freedom.

Blackmore?s reasoning strikes me as less spiritual than Orwellian. To me, choices, freely made, are what make life meaningful. Moreover, our faith in free will has social value. It provides us with the metaphysical justification for ethics and morality. It forces us to take responsibility for ourselves rather than consigning our fate to our genes or God. Free will works better than any other single criterion for gauging the vitality of a life, or a society.

Theologians have proposed that science still allows faith in a ?God of the gaps,? who dwells within those shadowy realms into which science has not fully penetrated, such as the imaginary time before the Big Bang banged. In the same way, maybe we can have a free will of the gaps. No science is more riddled with gaps, after all, than the science of human consciousness.

As I lay in bed this morning, however, my faith in free will wavered. Scanning my mind for something resembling will, I found a welter of roiling thoughts and anti-thoughts, a few of which transcended virtuality long enough for closer inspection. One thought was that, no matter what my intellect decides, I?m compelled to believe in free will.

Abruptly my body, no doubt bored with all this pointless cogitation, slipped out of bed, padded to the door, and closed it behind me.

Intensive Weight-Loss Intervention Linked With Increased Chance of ...

Among overweight adults, participation in an intensive lifestyle intervention (that included counseling sessions and targets to reduce caloric intake and increase physical activity) was associated with a greater likelihood of partial remission of type 2 diabetes; however, the absolute remission rates were modest, according to a study in the December 19 issue of JAMA.

?Diabetes traditionally has been considered a progressive, incurable condition wherein the best case scenario after diagnosis is tight metabolic and risk factor management to forestall vascular and neuropathic complications,? according to background information in the article. Some bariatric surgery studies have suggested that many diabetes cases among obese patients can be resolved. ?Patients diagnosed as having type 2 diabetes frequently ask their physicians whether their condition is reversible, and some physicians may provide hopeful advice that lifestyle change can normalize glucose levels,? the authors write. ?However, the rate of remission of type 2 diabetes that may be achieved using non-surgical approaches has not been reported.?

Edward W. Gregg, Ph.D., of the Centers for Disease Control and Prevention, Atlanta, and colleagues conducted a study to examine the association of an intensive lifestyle intervention with frequency of partial and complete remission of type 2 diabetes. The study consisted of an ancillary observational analysis of a 4-year randomized controlled trial (baseline visit, August 2001-April 2004; last follow-up, April 2008) comparing an intensive lifestyle intervention (ILI) with a diabetes support and education control condition (DSE). The study included 4,503 U.S. adults with body mass index of 25 or higher and type 2 diabetes.

Participants were randomly assigned to receive the ILI, which included weekly group and individual counseling in the first 6 months followed by 3 sessions per month for the second 6 months and twice-monthly contact and regular refresher group series and campaigns in years 2 to 4 (n = 2,241); or the DSE, which was an offer of 3 group sessions per year on diet, physical activity, and social support (n = 2,262). The ILI aimed to reduce total caloric intake to 1,200 to 1,800 calories a day through reductions in total and saturated fat intake and by increasing physical activity levels to a goal of 175 minutes/week. Liquid meal replacements were provided to assist dietary goals.

Participants in the ILI group lost significantly more weight than DSE participants at year 1 (-8.6 percent vs. -0.7 percent) and at year 4 (-4.7 percent vs. -0.8 percent) and had greater increases in fitness at both year 1 (20.6 percent vs. 5.3 percent) and year 4 (4.9 percent vs. -1.5 percent). The researchers found that the prevalence of complete remission (i.e., glucose normalization without medication) was more common in the ILI group than in the DSE group across all years of the study. However, the absolute prevalence was low, ranging from 1.3 percent for ILI vs. 0.1 percent for DSE in year 1; to 0.7 percent for ILI vs. 0.2 percent for DSE in year 4.

Additional analyses indicated that ILI participants were significantly more likely to experience any remission (partial or complete), with a prevalence of 11.5 percent during the first year, decreasing to 7.3 percent during year 4, compared with 2.0 percent in the DSE group at both time points. Rates of any remission were notably higher (15 percent ? 21 percent) among persons with substantial weight loss or fitness change, shorter duration of extant diabetes, or a lower HbA1c level (a measure of blood glucose) at entry and those not using insulin.

?The ILI group was significantly more likely to have continuous, sustained remission, as 9.2 percent experienced at least a 2-year remission (vs. for DSE, 1.7 percent) at some point during follow-up, 6.4 percent had at least a 3-year remission (vs. DSE, 1.3 percent), and 3.5 percent had a continuous 4-year remission (vs. DSE, 0.5 percent). The results from the complete case analyses were similar,? the authors write.

?The increasing worldwide prevalence of type 2 diabetes, along with its wide-ranging complications, has led to hopes that the disease can be reversed or prevented. These analyses of more than 4,500 overweight adults with type 2 diabetes confirm that complete remission associated with an intensive life-style intervention, when defined by glucose normalization without need for drugs, is rare. However, partial remission, defined as a transition to pre-diabetic or normal glucose levels without drug treatment for a specific period, is an obtainable goal for some patients with type 2 diabetes.?

David E. Arterburn, M.D., M.P.H., of the Group Health Research Institute, Seattle, and Patrick J. O?Connor, M.D., M.A., M.P.H., of the HealthPartners Institute for Education and Research, Minneapolis, write in an accompanying editorial that ?evidence-based and cost-effective diabetes prevention strategies should be more broadly applied using the full range of available technologies and incentives.?

?But that is not enough. Research, education, and policy efforts need to be focused further upstream, toward primary prevention: reducing incident obesity in children, adolescents, and adults, especially among those with a family history of obesity or diabetes. Prevention of diabetes and obesity should be a rallying cry for all clinicians who care about the health of the nation.

Britain suspends exploratory drilling of Antarctic lake

LONDON (Reuters) - An ambitious British plan to search for minute forms of life in an ancient lake beneath Antarctica's ice has been suspended because of technical problems, the scientist leading the project said on Thursday.

In a move that clears the way for U.S. and Russian teams to take the lead, Professor Martin Siegert said technical problems and a lack of fuel had forced the closure on Christmas Day of the 7-million-pound ($11 million) project, which was looking for life forms and climate change clues in the lake-bed sediment.

"This is of course, hugely frustrating for us, but we have learned a lot this year," said Siegert of the University of Bristol, principal investigator for the mission, which was headed by the British Antarctic Survey (BAS).

"By the end, the equipment was working well, and much of it has now been fully field-tested," he said on the BAS website.

Experts from Britain's Lake Ellsworth mission had expected to find minute forms of life in the lake three km (two miles) under Antarctica's ice, the most remote and extreme environment known on Earth.

They had also hoped that by dating bits of seashell found in the water they would have been able to ascertain when the ice sheet last broke up and to better understand the risks of it happening again.

INTERNATIONAL COMPETITION

Scientists from the United States and Russia are hot on Britain's heels when it comes to drilling through Antarctic ice to lakes that have been hidden for thousands of years.

The U.S. team is aiming to start drilling in Lake Whillans, one of 360 known sub-glacial lakes in Antarctica, in January or February 2013.

Russia was the first to pierce 3,769 meters (12,365 ft) of solid ice to reach Lake Vostok early in 2012. But some scientists believe their samples may have been contaminated by drilling fluids.

The British scientists decided to abandon the mission after trying for 20 hours to connect two holes in the ice that were needed for the hot-water drill to work, said a BAS spokeswoman.

Without a connection between the two holes, the hot water would seep into the porous surface layers of ice and be lost, reducing the pressure and rendering the drill ineffective.

The team tried to melt and dig more snow to compensate for the water loss, but without success.

As a result of the extra time taken to fix the problem, fuel stocks had been depleted to such a level as to make the operation unviable.

Asked how long the delay might be before the project could be resumed, Siegert told the BBC: "It will take a season or two to get all our equipment out of Antarctica and back to the UK, so at a minimum we're looking at three to four, maybe five years I would have thought."

However, he said he felt this year's mission had not been a complete loss.

The BAS spokeswoman said: "It's very possible that either the U.S. or Russia may take the lead but I think the one thing we've learned here is that anything can go wrong."

"We've never depicted this as a race. All sub-glacial lakes would give different information," she said.

Mario Vilela Orozco, a Beaverton School District employee who was involved in a dispute about his visa earlier this year, has regained legal status and a teaching job.

Vilela Orozco just returned from his native Peru, where he traveled to renew his H-1B specialty occupation work visa so he could stay legally in the United States.

Vilela Orozco said his visa was approved Dec. 10 and he could begin working in January at Beaverton's Southridge High School as a social studies teacher.

Vilela Orozco, 40, had worked since 2010 as a teacher in the two-way language immersion program at Whitford Middle School.

He said he repeatedly reminded the school district to update his visa, a promise officials made when they hired him. But he was fired in June for having improper documentation and his visa expired in September. The school district agreed in October to sponsor a new visa and teaching job.

Vilela Orozco, who graduated from Portland State University, came to the United States dreaming of a steady job and prospective American citizenship. He worked for the Estacada Web Academy in Clackamas before being hired in Beaverton.

Foreigners on H1-B work visas, which are valid for three years and renewable for another three, are authorized to work only for the employer who submitted the application. Once Vilela Orozco had worked for the new school district, he violated the terms of his visa. The only way to fix it was to go back to Peru and start over.

Mexico bishop inspires, infuriates with activism

MONCLOVA, Mexico (AP) ? The white-haired bishop stepped before some 7,000 faithful gathered in a baseball stadium in this violence-plagued northern border state. He led the gathering through the rituals of his Mass, reciting prayers echoed back by the massive crowd. And then his voice rose.

Politicians are tied to organized crime, Bishop Raul Vera bellowed while inaugurating the church's Year of Faith. Lawmakers' attempts to curb money laundering are intentionally weak. New labor reforms are a way to enslave Mexican workers.

How, Vera asked, can Mexicans follow leaders "who are the ones who have let organized crime grow, who have let criminals do what they do unpunished, because there's no justice in this country!"

In a nation where some clergy have been cowed into silence by drug cartels and official power, Vera is clearly unafraid to speak. That makes him an important voice of dissent in a country where the Roman Catholic Church often works hand-in-hand with the powerful, and where cynicism about politics is widespread and corrosive.

Vera's realm is a wide swath of Coahuila, a state bordering Texas that's become a hideout for the brutal Zetas drug cartel. It's where the current governor's nephew was killed in October and the former governor, the victim's father, resigned last year as leader of the political party that just returned to power with newly inaugurated President Enrique Pena Nieto.

Marked by his unvarnished speech, the Saltillo bishop's voice carries beyond his diocese here, especially when he weighs in on hot issues such as drug violence, vulnerable immigrants and gay rights.

In late 2007, Mexico City's Human Rights Commission denounced death threats against Vera and a burglary of the diocese's human rights offices. The following year, after Coahuila became the first Mexican state to allow civil unions for gay couples, a move the bishop endorsed, Vera was invited to speak at a U.S.-based conference for a Catholic gay and lesbian organization. In 2010, he was awarded a human rights prize in Norway.

Anonymous critics have hung banners outside the cathedral asking for what they called a real Catholic bishop. And last year, the 67-year-old was summoned to the Vatican to explain a church outreach program to gay youth.

Natalia Ni?o, president of Familias Mundi in Saltillo, told the Catholic News Agency last year that Vera had placed too much focus on supporting the gay community.

"A pastoral commitment to homosexual persons is necessary and welcomed, but not at the expense of the family and a solid pastoral plan for marriage and family, which is unfortunately being neglected in the diocese," she said.

Vera, who has had government bodyguards before, said he was foregoing similar security despite the criticism and threats. Such measures were rare and frowned upon in Saltillo, he said.

"I'm not the only one exposed, there are lots of people exposed who work with immigrants, with the missing," Vera said. "How do I cover myself? Them?"

Mexico's Bishops Conference did not respond to repeated requests for an interview about Vera. The church's hierarchy in Mexico did issue a statement in 2010 congratulating Vera on his human rights prize, and last year, the church condemned anonymous threats against him.

Vera's office often lends more weight to his words, especially when he speaks up about human rights, said Emiliano Ruiz Parra, a Mexican journalist and author of a new book that portrays Vera and other "black sheep" of the church in Mexico.

"Among the defenders of human rights he is the one who hedges the least, he says things the way they are," Parra said before Pena Nieto's Dec. 1 inauguration. "He's not afraid, for example, to take on the president, the one who's leaving or the president-elect."

Vera's homily on an October Sunday in Monclova included a lengthy diatribe about an alleged vote-buying scheme involving grocery store gift cards critics say were distributed by the Institutional Revolutionary Party, known as the PRI. Citing press reports, the bishop told the crowd organized crime paid for the scheme and helped Pe?a Nieto's victory. He also labeled as "collaborators" anyone who took a gift card in exchange for their vote.

"What we're seeing now is nothing other than the reaccommodation of the criminal groups with the new government teams," Vera said later as he raced back to Saltillo for another Mass. "The criminal groups always have their agreements with those who are in the state governments, in the federal government."

An industrial hub on the high desert about an hour west of Monterrey, Saltillo had long been known as a quiet haven in Mexico, distinguished by its auto manufacturing and a modern museum exhaustively detailing the surrounding terrain.

In recent years, however, the area has fallen victim to the drug violence plaguing other parts of Mexico. In 2011, 729 murders hit the state, compared to 449 the year before and 107 in 2006, according to preliminary figures released by the government this summer. Four bodies were found hanging from a Saltillo overpass earlier this month.

Until the nephew of Gov. Ruben Moreira was killed in early October, the political class had showed little concern for violence, Vera said.

"Fear of the conditions that Mexico is going through with the insecurity, with so much violence, makes us silent, and Don Raul is a strong voice who says what the rest of us are too scared to say," said Maria Luz Lopez Morales, a Vera friend and self-professed atheist who runs literacy programs for women in rural areas outside Monclova.

Vera arrived in Saltillo in 2000, after serving as the co-bishop in a deeply divided diocese in the southern Mexican state of Chiapas, where Zapatista rebels were battling government troops. He came with a reputation as a social crusader.

"Ever since I arrived here, as I came from Chiapas and I wasn't a person who was going to support the government, since this moment they decided that my image needed to be restrained," Vera said. He pointed to critical coverage from a local television network where a host once displayed Vera's picture surrounded by flames of eternal damnation. Vera said he believed the host was paid to do the government's bidding.

In February 2006, Vera celebrated Mass at the Pasta de Conchos coal mine where 65 miners had perished and spent days with their families hammering the mine's owners, government officials and union leaders for dangerous working conditions.

Five months later, he traveled to Castanos, a small town near Monclova, where soldiers had been arrested in connection to the sexual assaults of more than a dozen prostitutes. He and his longtime collaborator Jackie Campbell started their own investigation, leading the diocese's human rights office to successfully push to try some of the soldiers in civilian courts, where several were sentenced.

Mysterious cars followed Vera and Campbell during that time. Campbell's home phone line was cut and Vera was threatened. Campbell eventually moved to Argentina for three years to escape the harassment and to pursue graduate studies.

Vera has also demanded investigations into the thousands of migrants who have gone missing while passing through the state and clamored for a DNA database to identify bodies. In an email, the Rev. Pedro Pantoja, who oversees the diocese's migrant programs, said he's enjoyed total support from Vera and called his commitment to social causes "prophetic."

What's drawn perhaps the most controversy has been Vera's stand on gay rights, which even called Rome's attention. In 2001, the Rev. Robert Coogan, an American priest in Saltillo ordained by Vera, suggested starting an outreach program to gay youth, after a teenager came to him when his parents threw him out of the house. Vera lent his support to the program, called Comunidad San Elredo, and later escaped reprimand when called to the Vatican to explain it.

"It flows out of his conviction: The church is for everyone," Coogan said.

Parishioner Julia Castillo, of Saltillo, said Vera wasn't just making headlines with his bold stands. He was also inspiring Mexicans at a time when many are feeling besieged.

"He talks about all of the injustice there is right now, of all the danger there is, that we have to stick together to fight against the corruption, above all in the government and the police," Castillo said. "We like the way he is."

Suzanne de Janasz: The "E" in E-Communication: Electronic or ...

Nothing says "Merry Christmas" like a new smart phone, tablet, or computer. Just look at the last few weeks' worth of print and TV adverts. It seems like everyone wants the latest technology to be able to send a cryptic message to friends, loved ones, and the rest of the wired world. E-communication -- this new-age form of communicating -- get its name from using electronic means to transmit messages. I've come to believe that the "e" in e-communication stands for "evasive." The excitement of being able to communicate with anyone, anywhere, anytime has morphed into an annoyance (think mobile user in the gym, restaurant, or elevator) or a means of electronic courage to communicate a message that in years past had to be face-to-face conversation. E-communication has enabled the evolution of a new breed of user -- one with little social skills or emotional intelligence. Let me share a couple of examples.

A few years ago, during my organization behavior class -- part of the evening MBA program for working adults, a student proudly proclaimed that she used email to let her husband know when and why she was upset with him. I was teaching the topic of assertive communication, extoling the virtues of -- and sharing frameworks and techniques for -- open, direct, assertive communication. My examples -- deciding whether to send food back at a restaurant, being "cut" while waiting in a queue and dealing with an absent or unproductive team member -- provoked engaged dialogue filled with personal examples of responses to similar situations and the reasons behind them. The general consensus was agreement that direct confrontation was often the best, if most difficult, approach. Yet, this female student was adamant that "her" chosen method worked. Hard to argue with the seemingly happily married student, so I segued to the next conversation with a "let's agree to disagree" or "just as there are different ways to lead, so too is the case for communication" type of statement.

Fast forward about five years. I'm Skyping with my daughter -- a freshman at a university on the East Coast -- and what I hear horrifies me. She tells me that the previous evening, one of her classmates came to her dorm room to study for an exam. He stayed until about midnight, and the entire time, her roommate, Lisa*, said nothing -- no mention of needing to sleep, no questions about when he might leave, not even facial expressions that could have interpreted as discontent with the situation. The next morning, another female student living on the same floor informed my daughter that "I don't know if you know this, but Lisa has been tweeting about you." My daughter looked up Lisa's tweets, and identified seven that were posted during or immediately following the 90 minute study visit. "Could you please go to the study lounge? That's what it's for. I am SO TIRED. I would like to sleep because I have a test tomorrow." "I would like to go to bed. But there is a strange guy in my room." "As much as I love my roommate, this is the second time she had someone over late. I need to sleep!" The last two: "GOOOOOOODBYEEEEEE PLEEEEASEEEEE" and "I was getting legit pissed off" suggest my daughter's roommate was quite angry, but, and this is key, said nothing. In fact, after reading these posts, my daughter started a conversation with Lisa, and it went something like this:

Her: "Hey, I'm really sorry Peter* stayed so late last night. I didn't think he was going to be here so long."
Her roommate: "It's fine! No worries."
Her: "Well, again, I'm sorry if our studying kept you up late."
Her roommate: "It's no big deal. Don't worry about it."

Lisa had a right to ask my daughter to end the study session in their shared room, perhaps taking her into the hallway for privacy. Instead, by saying nothing directly to her, Lisa sent a different message: "have as many study sessions with friends in our room as you want.. .I don't mind." Is it any wonder that we find ourselves in sticky situations like this? Sure, we laugh about the co-workers in adjacent cubicles who email each other to see if they can go to lunch together. We frown over the texters who nearly plow into animate and inanimate objects -- which are clearly less important than the texts they're composing. And we are perturbed by others' lack of mobile phone etiquette. But when does "being connected" equate to "being socially inept?" How has using electronic forms of communication allowed us to abdicate responsibility for having direct, honest, and frank conversations when we need to? And worse, how do we respond to this phenomenon in ways that allow it to continue?

A few thoughts to start the conversation on how we might address this... What do you think?
1. Put yourself in the shoes of the recipient of the intended message. What method of delivery would you prefer? Easy or efficient doesn't always equate to effective.
2. Recognize that messages, posts, and emails have a semi-permanent life. Would you like this message printed, (re)posted, forwarded or even (re)tweeted?
3. Realize that most of us avoid doing things we think will be painful. But avoiding a tough conversation doesn't make the problem disappear; instead, it is likely to fester, create resentment, and become a silent wedge in a relationship. Practice the conversation first by writing it or role playing it with a trusted friend or colleague. Whether it's a public presentation or private conversation, a dry run helps increase comfort and confidence.

The Lore of Lastra

History

In the beginning there were four Dragon Gods: Ieer, Ki, Domieen and Barthomel. These four Gods pooled their power and created the land of Lastra (in the last RP it was called Dragoon. Lastra and Dragoon are one in the same.). They created humans to start, then elves, dwarves and other races of old. Each dragon had a companion whom shared in their power and glory. The Dragon God's also created other dragons in their image. Thus the race of dragons and men was born.

However, Barthomel, a large red dragon, turned his back on the other three and suddenly waged war upon them. He lusted for more power and thought that their creations had gone far enough, and had taken far too much from them. Ieer, Ki and Domieen fought back. Their war lasted for many years. Cities were destroyed, some races driven to near extinction, and the crack of Godly power coursed through the skies for days. The Gods were not alone in their fight, for those that they created fought with them as well.

Near the end of the war, Domieen shifted sides for unknown reasons and it was the final battle between the four Gods. Finally, Ieer and Ki managed to destroy Barthomel, throwing him down in their last expel of power. Both dragons died thinking that they'd killed both Domieen and Barthomel in one sweep. However, they were very wrong. Domieen escaped death that day, and from then forward built his power and plotted in the darkness.

Talon V'lyn, a young assassin aged 22 at the time got caught up in the middle of everything and ended up with Ieer's bracer. The bracer held all of the old Dragon God's power, and it flooded the young assassin's body that wasn't supposed to be filled with magic. He met a beautiful mage along the way as well. Though beautiful, she was quite a handful, irking him often, tempting him often and driving him insane with just about everything she did. Talon's home, Skyfall, was sacked first, falling under a rebel group that later became known as 'The True Dragons'.

The True Dragon's began ravaging the lands right after, making their presence known. Next, Crystacia fell, their Queen killed by Domieen's hand. Under the words of 'Blood and Magic, our True God will Reign,' the rebel group sought to destroy everything in their path. Talon decided then that he would go after the rebels, and with him went the mage, Jennifer, a Dark elf from the old Alliance, Locien, another dark elf Lyuze and one of the few surviving elves of Crystacia, Rania. Together, they all traveled from city to city, following the visions that were given to Talon via the powerful bracer on his arm.

Ro'ell was the first city that Talon had a vision about. So the group set out to Ro'ell and attempted to save the city, only to suffer losses. First, Talon was struck hard by the realization that Jennifer wasn't entirely on his side about everything. She had her own reasons for fighting with him, but her heart lay with destruction, especially towards the city where she'd been raised. With her illusion magic, she made him witness her killing the King of the city. Afterwards, she was kidnapped by Domieen who confronted him. Meanwhile, Locien was also taken from the city. Both were brought to Laowlee, where Domieen had set up his base of operations. Locien was taken because of his power with a being called 'The Seeker', and Jennifer because she was a prodigy mage and superior in power to other mages.

As they fought with the True Dragons, growing closer to their goal, it slowly became apparent that the bracer was growing in power, and it was taking it's toll on Talon's body. In Kingsburrow, the assassin went to the library and researched the old lore to find that the bracer that was permanently stuck to his arm was that of the old Dragon God's Ieer. He was also informed that only mages and other beings of power would be able to handle it, anyone else would die from it slowly. With that in mind, he went right into battle anyway.

Jennifer found out about this, but he had already left her in a rush to evacuate the city before the attack came. Talon succeeded in saving only a portion of the cities inhabitant. He engaged in battle with Domieen, only to nearly lose his life in the process. The city crumpled then, caving in on itself by Domieen's utter power. Whilst the others made it safely out, Jennifer and Talon fell into the caves deep below the city and were left to their own devices to get out.

The group rendezvous back at Vaye where they meet up and come up with a new plan of action for taking on Domieen. It was decided that they should go after him at Laowlee, taking the beast by the lair, so to speak. So, they set out for Laowlee with an army behind them. Locien had rallied the Alliance, whilst Talon sent out word for the assassins to meet up with them as well.

(To make things short, and seeing as the RP 'Reign of Dragon's' is still going, I won't spoil too much for those who are joining in on this RP from that one ;) They don't kill Domieen in Laowlee, they have to go after a couple other things, engage in battle with Barthomel who will be raised, and eventually kill them both :D Yay! Okay, back to serious tone...)

Dragons and Companions

Dragons are a life long companion. They are connected to their companion through a mental connection that no one's really quite figured out just yet. All they know is that it happens when a Dragon picks a companion to be with. Both companion and dragon will feel each others emotions, read each others thoughts, console and tease each other in affection, and should one be hurt in anyway, the other would feel it.

If a dragon dies, the companion is put through hell, but they do not die. The companion may find another Dragon to be with. If the companion dies, the Dragon is also put through hell, but doesn't die. However, the Dragon will never find another companion to be with.

Dragon's are the main source of travel in Lastra. Though the war forty years ago dwindled their numbers, they still roam the land. However, they aren't reproducing like they used to. Ever so slowly, the dragons are becoming an extinct race here in Lastra. In another fifty years or so, the dragons will most likely be all but gone.

(AP) ? An official statement says President Mohammed Morsi has ordered parliament's upper chamber to convene on Wednesday.

The statement Monday comes a day after Morsi appointed 90 members to the Islamist-dominated Shura Council. The 90 include at least 30 Islamists and six minority Christians. The council has a total of 270 members, two-thirds of them elected.

The toothless body was elected last winter by less than 10 percent of the 51 million eligible voters. It will assume legislative powers until a lower chamber is elected within the next two months. Morsi has had legislative powers since the lower chamber was dissolved by a court in June.

The council's empowerment is provided for in a new constitution passed in a referendum over the past two weekends, according to unofficial results.
